1. Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you and Nine3One2 LLC (“Nine3One2,” “we,” “us,” or “our”) governing your access to and use of the nine3one2.com website, our mobile applications (including WIMS — Slowpitch Softball Scorebook and Widget Play: Car Widgets), our custom website design and e-commerce engineering services, and any related software or cloud services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms.
2. License & Intellectual Property
Unless otherwise indicated, the Services and all source code, designs, logos, trademarks, graphics, and content are owned by Nine3One2 LLC and are protected by applicable intellectual property laws. Subject to your compliance with these Terms, Nine3One2 LLC grants you a personal, non-exclusive, non-transferable, revocable license to access the website and use our downloadable applications for their intended purposes.
Mobile applications downloaded through the Apple App Store or Google Play Store are additionally subject to the applicable platform’s standard End User License Agreement (such as Apple’s Licensed Application End User License Agreement).
3. Acceptable Use & Safety
You agree not to misuse the Services, attempt to reverse-engineer proprietary binaries, or interfere with the security or availability of our infrastructure. For automotive-related software (such as CarPlay dashboard widgets), you are solely responsible for obeying all traffic laws and maintaining full attention on the road while operating a vehicle.
4. Purchases & Subscriptions
Certain mobile features or software tiers may be offered via one-time in-app purchases or subscriptions processed directly through Apple App Store or Google Play billing. Billing, renewals, and refund requests for store purchases are governed by the respective app store platform’s terms and policies.
5. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NINE3ONE2 LLC DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NINE3ONE2 LLC OR ITS FOUNDER, MEMBERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law principles.
